Membership Policies & Waiver

This Membership Policy forms an integral part of the Arena Fitness Terms and Conditions. By becoming a Member, the Member agrees to abide by, and be bound to, the terms and conditions of this Membership Policy at all times. This Policy can be revised and updated from time to time at the discretion of Arena Fitness, and the most current version of the Membership Policy shall automatically form part of the Membership Agreement, irrespective of when the Membership Agreement was entered into. 

Cancellation Policy

Arena Fitness has a strict “No Cancellation Policy”, any purchase made cannot be canceled or refunded. In exceptional circumstances, Management may consider a membership transfer to another person at no cost.

Auto Renew Cancellation Policy

Any auto-renew payment made cannot be canceled or refunded. You must terminate your auto-renew subscription before payment is processed, following the prescribed method contained in this Membership Policy.

Auto Renew Subscription Termination Policy

All cancellations of auto-renewal memberships must be made through your account on the Arena Fitness website at least 72 hours before your next payment is due. You can always access your account at any time online through the website to see when your next payment is due. If you fail to cancel your membership earlier than 72 hours before your next payment is due and your membership is auto-renewed, a refund will not be provided. It is your responsibility to cancel your membership within the time frames set out above.

Refund Policy

Arena Fitness has a strict no refund policy. Any payments made towards any membership or auto-renew subscription or other product or service are non-refundable.

Non-Auto Renew Membership Freeze Policy:

  • The policy will automatically apply to any purchased memberships as followed:
    • 3-month membership – 2 weeks total, up to 2 freeze periods
    • 6-month membership – 4 weeks total, up to 3 freeze periods
    • 12-month membership – 6 weeks total, up to 4 freeze periods
  • Unused freeze periods will not accumulate.

Auto Renew Membership Freeze Policy:

  • All auto-renewing memberships are entitled to up to 60 days freeze per year of membership
  • The minimum freeze period is five (5) days for any request. Freeze requests for less than the minimum freeze period will not be actioned
  • You must request your freeze via the phone or at the Arena Fitness website https://crossfitabudhabi.com

Teachers Membership Freeze Policy:

Any teacher’s membership can only be frozen during the school holiday periods.

Auto Renew Installment Memberships

Any auto-renew installment memberships are set for a ‘minimum installment period’. The auto-renew minimum installment period is the number of installments required for the tier level of membership purchased. For example, an annual auto-renew installment membership requires a minimum of 12 installments to be paid. The membership will continue at the same monthly rate once the minimum installment period is reached until such membership is canceled in accordance with the cancellation policies. If a member wishes to cancel the membership before all installments are paid, the member must pay out the total outstanding value of the membership.

Special Memberships

Any special memberships, such as Teachers memberships, Cabin Crew memberships, etc, are memberships that are on a different tier rate to regular memberships. Such special memberships require proof of identification in order to avail them. If proof of identification is not provided, such membership will not be available to the person so requesting. If any member is no longer entitled or eligible to such a membership at a future date after purchasing them, such membership will be cancelled.

Any aspect of a special membership, such as price, freeze policies, access policies, etc, may be altered at any time without recourse.

1.2 Do we offer any discounts?

Using a Corporate Discount Concession, Discount, and Teachers/Term Memberships

A preferred partnership discount is available to employees of a company in which we hold a corporate agreement, or if you are a teacher availing of a Teacher/Term membership. You will be required to provide proof that you qualify for the corporate discount concession, discount or for the Teacher/Term membership. Any corporate discount concession, discount or for the Teacher/Term membership can only be availed in accordance to the terms and conditions set forth by Vogue Fitness and is specific for each corporate agreement. 

If you deliberately claim a corporate discount concession, discount or for the Teacher/Term membership and you are not eligible or entitled to claim such concession or discount, this will be viewed as a fraudulent attempt to obtain a discounted membership. In the event that you have fraudulently attempted to obtain a benefit in this manner, your membership will not be honoured and you will not be entitled to any refund.

Student Discount Concession

We do not offer student discounts however Vogue Fitness may alternatively offer student programs at a subsidised rate.

1.3 How old do you have to be?

Meeting our minimum age

You can participate in classes where the age range is designated for you. The age range for adult classes is 17 years and above, however, special consideration may be provided for people under this age provided that they receive special permission. Special permission will only be provided to those that are proficient in the required movements and such movements will be assessed independently by a representative of Arena Fitness. There is no recourse for appeal and Arena Fitness’s decision will be final. 

Any other age limit will be clearly defined in the program, such as kids programs, etc, which will clearly identify the age requirements. 

1.4 When does your agreement start?

Signing your agreement

You have an agreement with Arena Fitness from when you complete payment of your membership, and in case that membership is not paid for, your agreement will commence from your first visit to a Arena Fitness facility.

Understanding Your rights

If we do not enforce our agreement rights at any time, it does not mean we have waived those rights, no matter how long we wait. If there is a miscalculation in your membership agreement, we can correct this at any time and you must inform us via email at [email protected].

1.5 What about your health?

Promising you are in good health

On the day you sign your agreement and each time you use our facility, you promise us that:

  • You are in good physical condition.
  • You have no medical or other reason why you cannot or should not do active or passive exercise.

Seeking expert medical advice

Our staff and contractors are not medically trained. They are not qualified to assess if you are in good physical condition or state if you can exercise without risking your health, safety, or comfort. It is your sole responsibility to seek expert medical and other advice before starting any exercise program with Vogue Fitness. This remains your own responsibility at all times.

2. Things to know during your Membership

2.1 When do you pay membership fees?

Payment for Membership

All memberships, including programs, are paid for in full before the commencement of the membership or program. The payment methods are cash, card, online payment, and through our payment gateway online, and other online payment gateways as authorized by Arena Fitness.

Auto-renew payments will run automatically in accordance with the parameters of the membership type that you subscribed to and will continue to run until canceled by you in accordance with the processes outlined within this Membership Policy.

Auto Renew payments will be deducted from the payment method registered on your account through the Arena Fitness website. You can update your payment method or card details through such an account.

Renewal of Membership

When your membership is due to expire, you can choose to renew it before that date at the prevailing rate, otherwise, your membership expires and you will be subject to any waiting lists that may be applicable and/or the most current price fee. By renewing your membership, you agree to the membership terms that apply at that time. If you do not renew your membership before its expiry, Arena Fitness reserves the right to not renew your membership if your membership placement has been provided to a waiting member.

If you have an auto-renew membership, your membership will automatically renew until you cancel your auto-renew membership by following the process outlined in this Membership Policy. 

If you query a payment, we will do our best to respond within 7 days. If you are not happy with our response, you may contact the relevant regulatory body that will handle your query in line with their own policy.

2.2 What happens if your payment is late or fails?

Losing your gym, class and/or session access

If there is a failed payment, our team will contact you immediately to inform you of this and your membership will be placed on hold until it is resolved. Once payment is made, the dates of the membership will not be extended from their original dates. It is your responsibility to ensure that payment is made on time and that any necessary funds are available at the time of billing. If you do not rectify the payment, your membership will be canceled.

2.3 What happens if I want to change memberships?

Changing memberships

Once a member enters into membership, the membership is non-refundable and cannot be changed. You are however able to upgrade your membership, if you are on an auto-renewing membership you can upgrade via your account on the Arena Fitness website if you do not have an auto-renewing membership you can upgrade by visiting https://crossfitabudhabi.com.

2.4 What about the class reservation policy?

Reserving Classes

You must pre-book for all classes through the prescribed online application. If you are unable to access the application, then you must email [email protected]. If you do not reserve your class, then you may be denied entry in participating in it.

3-Strike Policy

If you reserve your spot in any of our classes and fail to attend 3 times in any given three (3) month period, you will be banned from attending any classes for two (2) days. There will be no refunds, returns, or compensation in any form in the event that this policy is enforced. It is your responsibility as a member to turn up to any classes that you reserve.

Waiting Lists

In the event that membership availability is at capacity, you can register on the waiting list to attend the class. In the event that someone cancels, you will automatically receive an email to attend.

2.5 Can we change your agreement?

Staying up to date with our terms

We may sometimes add to, change or remove our terms and conditions. This includes changing our opening and closing hours, its services and facilities, and membership fees. Sometimes, we may also close facilities for refurbishment to improve their facilities or during events close to a facility, during any public holiday in the UAE, or on any other day decided by Management. We do not reduce your membership fees because your facility is closed during any period. The most up-to-date terms and conditions always apply. 

2.6 How can you protect your health?

Telling us about your health risks

If you believe any facility activities might risk your health, you must inform Arena Fitness immediately in writing with full details. You must also tell us if your medical condition changes after you join.

Managing infections and illnesses

You must not use Arena Fitness facilities for the following reasons:

  • You have an infection, contagious illness, or physical ailments, such as an open cut or sore.
  • There is any other risk, however small, to any person in our facilities.

In the event that Arena Fitness closes due to any government mandate or due to any infectious disease, Arena Fitness is not required to refund your membership. At its sole discretion and election, Arena Fitness may freeze your membership until further notice.

Any policies enacted in accordance with government directives will not result in any refunds or cancellations being given by Arena Fitness.

2.7 Signing up for programs additional to membership

Signing up for additional Programs and Services

We will offer additional ‘Programs’ outside of our regular membership. The Programs are provided in addition to the Memberships outlined in this Agreement, and accordingly, additional fees and charges will apply and any terms and conditions applicable to the program will be applied to your membership.

2.8 How can you give us feedback?

Providing Feedback

You can provide feedback to us at any time via email to [email protected], by talking directly to our staff, by written note, or by phoning us at any time. We will also send feedback questionnaires from time to time.

Commenting on your membership

Your feedback is important in helping Arena Fitness provide our members with a great service. If you have any comments or questions regarding our facility, website, or service, we welcome you to contact us at [email protected]. We will make every attempt to respond within 24 hours, where possible. Some inquiries are more complex than others and might take time to resolve, but you will be notified.

3. Membership Cancellation Policy

Cancellation Policy

Arena Fitness has a strict “No Cancellation Policy”, any purchase made cannot be canceled or refunded. In exceptional circumstances, Management may consider a membership transfer to another person at no cost.
Any auto-renew memberships can only be canceled in accordance with the Auto Renew Cancellation Policy.

Auto Renew Cancellation Policy

Any auto-renew payment made cannot be canceled or refunded. Auto-renew memberships may be canceled only once any minimum membership term has been completed. To cancel any auto-renew membership, the member must complete a request at www.crossfitabudhabi.com at least 3 days prior to their next renewal payment.

Auto Renew Subscription Termination Policy

All cancellations of auto-renewal memberships must be made through your account on the Arena Fitness website at least 72 hours before your next payment is due. You can always access your account at any time online through the website to see when your next payment is due. It is your responsibility to cancel your membership within the timeframes set out above. 

Refund Policy

Arena Fitness has a strict no refund policy. Any payments made towards any membership or auto-renew subscription or other product or service are non-refundable.

Can you transfer your Membership to another person?

You cannot transfer or assign your membership to any other person or third party unless exceptional circumstances exist. Arena Fitness will be the sole determiner of what constitutes ‘exceptional circumstances’ and such a decision is not open to appeal. 

4. Arena Fitness Facility Code

You must follow our facility code of conduct always. This includes facilities managed and operated by Arena Fitness. Failure to do so may result in your membership being terminated without a refund.

4.1 What rules apply to our facilities?

Respecting our equipment

You are responsible for using our facilities and equipment correctly, including adjusting levels or settings. If you are not sure how to operate any equipment, please ask our staff before you use it. Note that you will be responsible for any damage that you or your guests cause through a willful act or negligence. As a courtesy to other members, please ensure the following:

  • Use a clean towel when you use equipment, including exercise mats.
  • Keep to the set time limits.
  • Keep phone calls to an absolute minimum.
  • Put equipment away after use.
  • Always obey staff directions.

Use of Cameras

Photos and social media are actively encouraged, however, you may not take photos of any member or guest who requests not to be in a photo, or in areas where signs exist not to take photographs. 

Taking care in wet areas

Any open water swimming is strictly prohibited without qualified supervision. If you choose to swim at any time without supervision, this will be at your own risk.

Keeping your belongings safe

We provide some lockers in certain facilities, and you can use them while exercising, however, be aware they are not secure lockers. Please keep your access card with you and do not bring valuables into the facility. Unfortunately, theft does happen. We cannot accept responsibility for any loss or damage to your belongings while you are at the facility, including if someone enters your locker without permission. If you leave belongings in a locker overnight, we may remove them. We give lost property to charity each month, including unclaimed items from lockers.

Wearing suitable clothes

All members and guests must wear suitable attire and enclosed sports shoes in any exercise areas, except for wet areas. We do not allow clothing with offensive images or inappropriate advertising. Any staff member, at their discretion, and in line with this Policy, may refuse you entry to our facilities or ask you to leave if your clothing is deemed inappropriate, offensive, or unsuitable, at the discretion of Arena Fitness management.

Parking

You park in the facility’s car park or on facility premises at your own risk. We are not liable for any loss or damage to your vehicle or its contents.

Provision of Towels & Water

Towels and water are provided at our discretion and do not form a commitment from us to our members. We may cease providing this service at any time without recourse. If you are caught stealing any towels provided by us, your membership will be immediately canceled and no refund provided. Towels can be purchased at request. Towels and water are provided at our discretion and do not form a commitment from us to our members. We may cease providing this service at any time without recourse.

Intentionally Damaging Equipment or Facilities

If you intentionally damage any equipment or any part of the facility, you will be liable for the full replacement value of such equipment.

Drug & Banned Substance Abuse Policy

There is zero tolerance for drugs or banned substances. If any member is found to be encouraging, supplying, facilitating, or taking illegal drugs or banned substances, their membership will be immediately canceled without recourse and no refund will be given.

4.2 Can you bring guests to the facility?

Paying for guests

Any guest must enter as any other member would, including holding a valid membership. 

4.3 What happens if you break a Membership Policy?

Being refused entry or receiving a warning

We can refuse entry to anyone, including members if they act unreasonably or break the Arena Fitness facility code. If you continue to breach the facility code, your membership will be canceled with immediate effect at the discretion of the management without recourse. If your membership is canceled you will not receive any refund for any amounts paid.

Facing instant cancellation

Your membership may be canceled without warning if you behave in an inappropriate manner, for example, if you:

  • Threaten, harass or intimidate others.
  • Continually disobeying staff directives.
  • Damage equipment.
  • Use, supply, or encourage illegal performance-enhancing drugs.
  • Instruct other members when we have not authorized you to do so.
  • Actively try to damage the Vogue Fitness brand or reputation.
  • Any reason as deemed appropriate by Management at their discretion.

5. Legal stuff you need to know

5.1 What are your responsibilities?

Meeting your responsibilities

Your responsibilities, including payment of membership fees, do not depend on how often you use our facilities.

Promising to take care

You hereby promise to make sure that you know how to exercise safely, by seeking advice from our qualified staff members. You also promise to use your best endeavors to exercise safely always without exception. You should not take valuables into the facility, even if you plan to put them in a locker, as we take no responsibility for the loss or theft of any personal items, and you do so at your own risk.

5.2 Do we have a privacy policy?

Understanding our privacy policy

During your membership, we will have access to personal information about you, such as your health and financial situation. We will only use your contact information provided to contact you for marketing or other purposes.

Allowing us to use your image

We sometimes film or photograph our classes and facilities, so it is possible you will appear in our marketing material either on our website, print, social media, or otherwise. By entering into this Membership Agreement, you allow us to use your image in promotional and other business-related material unless you inform us otherwise in writing.

5.3 What about my medical Conditions?

By using our facility or attending our sessions, classes and/or programs, you declare yourself to be physically sound and suffering from no condition, impairment, disease or infirmity, or other illness that would prevent you from participating or use of equipment. Your health and medical conditions are your responsibility. If you suffer from any medical condition(s) at all, you must seek first medical advice before undertaking any form of physical activity. This is a prerequisite before commencing your membership. If at any point you feel that you should not participate in any session for any reasons whatsoever you acknowledge that it is solely your responsibility to immediately cease training and seek professional medical help.

5.4 What else should you know?

Legal Liability & Indemnity

As a participating member of ARENA FITNESS GYM L.L.C L.L.C, you strictly agree at all times to take all responsibility and liability for any injuries and/or damages resulting from my participation in any fitness activities including through the use of equipment.

Voluntary Assumption of Risk

You understand and are aware physical training and activity including the use of equipment, are potentially hazardous activities. You understand that exercise and fitness activities involve a risk of injury and even death and that you are voluntarily participating in these activities and using equipment and facilities with the knowledge of the dangers involved. You agree to assume and accept all and any risks of injury or death.

Indemnity and Disclaimer

At no point will the ARENA FITNESS GYM L.L.C L.L.C, the employee, or any Director be liable for any advice given in any capacity to any Member at any point. By becoming a Member, you fully indemnify and hold harmless ARENA FITNESS GYM L.L.C L.L.C, including all employees, directors, and owners, at all times from all actions, be them legal or otherwise, arising from any events whatsoever, however, connected to us, without exception.

Waiver

By becoming a member and/or entering any Arena Fitness facility, or conducting or participating in an activity related to Arena Fitness, you hereby fully agree to the Arena Fitness Waiver, Terms & Conditions

6. Personal Training, Home Personal Training & Swim Training Policies

6.1 Cancellation Policy

Arena Fitness has a strict ‘zero cancellation policy. Before booking or making a payment, please ensure that you have selected the correct membership or program as no refunds will be given under any circumstances. Arena Fitness will not be responsible if you are unable to complete your membership or program and no cancellation or refund will be provided.

6.2 Cancellation of Session &‘No Show’ Policy

Should you need to cancel a personal training session with your Coach, you must notify them within 24 hours of the session. If notification is not received, Vogue Fitness has a ‘no show’ policy and you will be charged full rate for that session.

6.3 Refund Policy

Arena Fitness has a strict ‘no refund or return policy. Any purchases made will not be refunded. In the event that the booking error has occurred through the absolute fault of Arena Fitness, a refund will in most cases be issued to the same credit card you used for the original purchase. Please allow up to two billing cycles for the credit to appear on your credit card statement.

6.4 Group Training Policy

At Arena Fitness we actively encourage you to train with a friend/family member(s). However, this is an additional service and therefore requires an additional payment. Please speak with your coach if you would like a friend to join you. Please note that if any member(s) of the group is not present during any session provided, it will still count as a full session delivered. It is the responsibility of each person to ensure that they are present at each group session. No refunds will be provided if one or more persons are unable to attend any session.

6.5 Aggressive or Inappropriate Client Behaviour Policy

At Arena Fitness we practice the highest standards of professionalism and integrity. If any client makes any of our staff feel uncomfortable or exhibits any form of, inappropriate or aggressive behavior, our staff have been trained to immediately leave, and contact upper management (and the police if necessary). In such an event, the appropriate actions will be taken and all outstanding sessions shall become null and void and no refunds will be provided.

7. WAIVER & INDEMNITY

  1. I understand that Arena Fitness has a ‘no refund’ policy.  All memberships once purchased are non-refundable.
  1. I am aware and agree that the most current version of the Arena Fitness Membership Policy found at www.crossfitabudhabi.com/membership-policy shall apply at all times to your membership, irrespective of the date that you have entered this Agreement and is subject to change at any time.  You hereby agree that any changes made will apply automatically to you and will supersede this document insofar as there is any conflict between them.
  1. I understand and accept that by participating in any ARENA FITNESS GYM L.L.C L.L.C activity, or attending any of their classes, workshops, programs, activities, or events, and participating in any related activities, whether they be indoors, outdoors, on land, or in water, and whether or not the location is connected to Arena Fitness or not in any way, I do so at my own risk AT ALL TIMES.
  1. I am aware of no reason, medical or otherwise, for me to abstain from participating in physical activity.  I agree that Arena Fitness or any entity directly or indirectly controlled or related to Arena Fitness will not be responsible or liable for my death or any physical and/or mental injury I occasion, or any damage to personal property arising out of or in relation to my participation in my membership and/or activity whether caused by a breach of contract or negligence of Arena Fitness or any of its Affiliates or otherwise.
  1. I hereby fully indemnify and hold harmless Arena Fitness and all of their Affiliates, servants, agents, employees, Directors, contractors, and volunteers, and I waive all claims against Arena Fitness for any loss or damage suffered by me, or costs or expenses incurred by me, arising out of or in relation to my participation in any and all activities connected or related to this Agreement, however, caused.
  1. To avoid any ambiguity, I understand that this waiver applies to any activity that is connected in any way to Arena Fitness, whether it be indoors, outdoors, in water or on land, on Arena Fitness premises, or not on Arena Fitness premises.
  1. I specifically understand that there is an inherent risk of injury at all times whenever undertaking physical activity, and I do so, at all times, at my own risk, and without any recourse, be it legal or otherwise.
  1. I guarantee that | will not undertake any actions, be it legal or otherwise, for any injury or death arising from participating in any activity related to Arena Fitness, be it directly or indirectly.
  1. I agree to follow the Arena Fitness rules at all times.  I hereby consent and understand that I voluntarily provide my own personal details at my own risk and liability with no recourse, be it legal or otherwise, to Arena Fitness.
  1. I warrant and agree that I am medically fit to undertake an intensive exercise program and that I do so voluntarily at my own risk at all times.  If I am unsure if I am able to participate, I warrant that I have sought independent medical advice and obtained the necessary clearances to participate in this Membership and its associated programs, etc.  I understand that my health remains my responsibility at all times.
  1. I agree that I have read, or will take the time to read and understand, the Arena Fitness Membership Policy.  I agree to be strictly bound by the most current Membership Policy at all times and that I will strictly adhere to, without exception, the most current version of the Membership Policy, which can be accessed anytime on the website crossfitabudhabi.com/membership-policy
  1. I agree and understand that by participating in any of the Arena Fitness programs or becoming a member and signing this agreement I agree and forever grant Arena Fitness, and its associated marketing agencies and 3rdParties, the rights to any and all images obtained of me and I hereby waive all rights over any such images.  I also agree that such images may be used by Arena Fitness at any time for marketing purposes, and this includes the usage of such images on Social Media platforms, emails, and any other form of electronic and print distribution.
  1. I understand that Arena Fitness reserves the right to close for Public Holidays, Abu Dhabi, and any other day deemed appropriate without any recourse or compensation and change class timings and offerings at any time without recourse.
  1. I hereby waive all and any right or cause of action which with respect to injury, physical impairment, out of the loss of life, or injury and damage, or loss of any description whatsoever which I or my child and/or children and family may suffer.
  1. I understand that if I elect for a Personal Training Membership, strict policies shall apply and that I agree to all such policies which are found at crossfitabudhabi.com/membership-policy
  1. In the case of a Minor member, the Parent or Legal Guardian shall sign on their behalf and take full legal responsibility and the terms of this Membership Agreement shall apply to them in full.
  1. I understand that electronically signing this document it will bind me to all terms and conditions of this Agreement and that the electronic reproduction of this Agreement will serve as an original signature in any Court of the United Arab Emirates.

  1. I understand that in the event of a pandemic or other event causing the closure or reduced capacity of Arena Fitness, such pandemic or event does not entitle me to a refund.
  1. I understand that I must abide by all governmental regulations in place that are in existence at the time of training, and that refusing to follow such rules means that I will forfeit my membership without a refund.
